Ici, je vais essayer de r\u00e9sumer mes (petites) lectures (r\u00e9centes &#8211; Oct 2013) sur la question de la propri\u00e9t\u00e9 des pages\/documents\/supports num\u00e9riques que l&#8217;on peut produire pour ses cours et mettre \u00e0 la disposition des \u00e9tudiants pour r\u00e9aliser son enseignement (sur le web, des lms [ex. : Moodle], des plateformes de partages de documents, de vid\u00e9os, etc.). Ces cr\u00e9ations de l&#8217;esprit sont-elles encore \u00e0 moi, ou appartiennent-elles \u00e0 l&#8217;universit\u00e9, \u00e9ventuellement au public qui les as re\u00e7u ?<\/p>\n<p>Pour comprendre la situation il faut lire la loi :<\/p>\n<ul>\n<li>code de la propri\u00e9t\u00e9 intellectuelle (http:\/\/www.legifrance.gouv.fr\/affichCode.do?cidTexte=LEGITEXT000006069414)<\/li>\n<li>code le l&#8217;\u00e9ducation (http:\/\/www.legifrance.gouv.fr\/affichCode.do?cidTexte=LEGITEXT000006071191)<\/li>\n<\/ul>\n<p>mais ce n&#8217;est pas suffisant ou assez clair, en particulier le code de l&#8217;\u00e9ducation ne dit pas grand chose sur la question.<\/p>\n<p>Il faut donc poursuivre la lecture, par exemple :<\/p>\n<ul>\n<li>un\/e bon\/e rappel\/synth\u00e8se de la loi et quelques commentaires : http:\/\/fr.jurispedia.org\/index.php\/Droits_d%27auteur_des_agents_publics_%28fr%29<\/li>\n<li>le contexte et un rappel de la loi (p. 32) : http:\/\/media.education.gouv.fr\/file\/2008\/08\/3\/universitenumerique_22083.pdf<\/li>\n<\/ul>\n<p style=\"text-align:left\">\u00c0 force, il ressort de ces lectures (en privil\u00e9giant les plus s\u00e9rieuses) que la position de l&#8217;enseignant du sup\u00e9rieur est la suivante (c&#8217;est l&#8217;exception dans l&#8217;exception) :<\/p>\n<p style=\"text-align:left;padding-left:30px\"><strong>Le droit standard s&#8217;applique : l&#8217;enseignant du sup\u00e9rieur poss\u00e8de les droits moraux et patrimoniaux sur son \u0153uvre.<\/strong><\/p>\n<p>Attention, \u00e0 ne pas confondre avec la position de l&#8217;enseignement primaire ou secondaire, o\u00f9 la situation est moins favorable \u00e0 l&#8217;enseignant (\u00e0 partir du moment o\u00f9 il y a cr\u00e9ation et divulgation d&#8217;une \u0153uvre dans le cadre d&#8217;un enseignement, les droits de l&#8217;enseignant sont restreints, en particulier, il n&#8217;a plus acc\u00e8s -quand cela a du sens- au droit de retrait).<\/p>\n<p>Cela n&#8217;interdit pas des pratiques dans le sup\u00e9rieur o\u00f9 les \u0153uvres sont propri\u00e9t\u00e9s de l&#8217;universit\u00e9, cela peut se faire via des contrats suppl\u00e9mentaires pour que l&#8217;universit\u00e9 soit propri\u00e9taire de ces \u0153uvres (ex. : http:\/\/www.univ-angers.fr\/fr\/vie-a-l-universite\/services-numeriques\/audiovisuel.html).<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Est-on propri\u00e9taire des supports (num\u00e9riques) de son cours \u00e0 l&#8217;universit\u00e9 ?
